These Terms of Service (“Terms”) govern your access to and use of the Rabbit Food website and ordering platform (the “Platform”). They constitute a legally binding agreement between you and Rabbit Foods (trading as “Rabbit Food”).
By accessing or using the Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform. For any questions, please contact us at support@tryrabbit.food.
These Terms do not affect your statutory rights as a consumer under UK law.
1. Information about us
The Platform is operated by Rabbit Foods, trading as Rabbit Food (“we”, “us”, “our”).
- Address: 7 Church Lane, Felixstowe, IP11 9DJ, United Kingdom.
- Contact email: support@tryrabbit.food
2. Our role
Rabbit Food operates an online marketplace that allows consumers (“Customers”) to order food and beverages from independent third-party restaurants and food businesses (“Restaurants”).
Contract for Sale: When you place an order, you are entering into a contract for the supply of goods directly with the Restaurant. We act as an agent for the Restaurant to conclude the sale and process your payment. We are not the seller of the food or beverages and do not handle the preparation, safety, or quality control of the products.
Delivery: Unless explicitly stated otherwise, delivery services are provided directly by the Restaurant or their designated couriers. We are not a transport provider and are not responsible for the acts or omissions of delivery drivers.
3. Access and eligibility
You must be at least 18 years old to place an order on the Platform. By placing an order, you warrant that you are legally capable of entering into binding contracts.
You are responsible for making all arrangements necessary for you to have access to the Platform. You are also responsible for ensuring that all persons who access the Platform through your internet connection are aware of these Terms and comply with them.
4. Orders and acceptance
Your order constitutes an offer to purchase goods from the Restaurant. All orders are subject to acceptance by the Restaurant.
Acceptance: A contract for the supply of goods is formed when you receive a confirmation notification (on-screen or via email/SMS) that the Restaurant has accepted your order. The Restaurant may reject an order for any reason, including kitchen capacity, item unavailability, or delivery constraints.
Availability: All items are subject to availability. Restaurants may occasionally run out of ingredients or be unable to fulfil specific requests.
5. Allergens and dietary requirements
Important: Restaurants are solely responsible for providing accurate ingredient and allergen information. Rabbit Food does not independently verify the ingredients or preparation methods used by Restaurants.
If you have a food allergy, intolerance, or specific dietary requirement, you must contact the Restaurant directly before placing your order to confirm the food is suitable for you. Do not rely solely on menu descriptions, as cross-contamination risks may exist in busy kitchens.
6. Price and payment
The total price of your order will be set out at checkout, including the price of the goods, delivery charges (if applicable), and any applicable taxes.
Platform Fee: To help us operate and improve our services, we charge a Platform Fee (sometimes referred to as a "Service Fee") payable by you directly to Rabbit Food. This fee is separate from the amount paid to the Restaurant for your meal and delivery. The exact amount of the Platform Fee will be clearly displayed in the order summary before you complete your purchase. By placing an order, you agree to pay this fee.
Payment is processed securely via our third-party payment processor, Stripe. You authorise us (via Stripe) to charge the payment method provided for the full value of the order.
7. Delivery and collection
Estimated times for delivery and collection are provided by the Restaurant and are only estimates. Neither we nor the Restaurant guarantee that orders will be delivered or available for collection within the estimated times.
You must be available to accept delivery at the address provided. If you are not available, the driver may leave your order in a safe place or return it to the Restaurant. In such cases, you will still be charged for the order.
8. Cancellation and refunds
Right to Cancel: As the goods supplied are perishable food items made to your specifications, you do not have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the Restaurant has started preparing it.
Refunds: If your order is missing items, incorrect, or of unsatisfactory quality, please contact the Restaurant immediately. You have legal rights under the Consumer Rights Act 2015 for goods to be of satisfactory quality and as described. Refunds are at the discretion of the Restaurant, but if you are unable to resolve a dispute, you may contact Rabbit Food support for assistance.
9. Age-restricted products
Orders containing alcohol or other age-restricted items can only be made by persons aged 18 or over. The Restaurant operates a "Challenge 25" policy and may request valid photo ID on delivery or collection. If you cannot provide ID, the item will be withheld and no refund may be given.
10. Our liability
To the extent permitted by law, Rabbit Food provides the Platform on an "as is" and "as available" basis. We exclude all implied conditions, warranties, representations, or other terms that may apply to the Platform or any content on it.
We are not liable for:
- The acts or omissions of Restaurants or delivery drivers.
- The quality, safety, or suitability of the food or beverages supplied.
- Any loss or damage that is not a foreseeable result of our breach of these Terms.
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
11. Data protection
We process your personal data in accordance with our Privacy Policy. By using the Platform, you consent to such processing and warrant that all data provided by you is accurate.
12. Changes to terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
13. Governing law
These Terms are governed by English law. You and we both agree to submit to the exclusive jurisdiction of the courts of England and Wales.
